1. Search MCRSearch by first name, last name, or the full case number.
2. Check that the case location, filing date, agency, statute, and other identifiers point to Lewis County and the right matter.
3. Look for a transfer or preliminary-hearing entry. A transfer is not a conviction.
4. Search WVPASS for the Circuit phase, then call the filing clerk if a scan or older record is missing.
5. Use WVSP fingerprints for an official review of your own repository record, since court portals are not CIB rap sheets.

Official Background Checks in West Virginia

The West Virginia State Police Criminal Identification Bureau is the central repository for Lewis County criminal history data. It is biometric, meaning the record is tied to fingerprints rather than only a typed name. West Virginia does not offer an unrestricted public CIB name search. Release to a private or public requester under state law requires the subject’s signed and acknowledged authorization plus superintendent approval.

WVSP sends applicants to IdentoGO or 855-766-7746 for current fingerprint appointments. WVSP says its headquarters counter and local law-enforcement fingerprinting are not the current routes. No official in-county enrollment site was confirmed, so check the appointment system for a current location and service code. A Lewis County court result is not a national or state repository history.

This state channel is the correct source when identity certainty matters more than a court-name match.

Lewis County Custody Record Route

Lewis County has no county jail. Local detainees normally enter the state-run Central Regional Jail and Correctional Facility in Sutton. That makes the custody trail less compact than the court trail. The WVDCR Offender Search hub links Daily Incarcerations, Jail Offender Search, Prison Offender Search, and escapee or absconder information.

For a recent Lewis County event, check Daily Incarcerations, then use the jail name search with at least the first three letters of the last name. The portal has no county dropdown on its name form and was intermittently blocked during research. If it fails, call Central Regional Jail at 304-765-7904 or use VINE at 1-866-984-8463 for custody notification. VINE tracks status changes; it is not a full criminal history.

Booking and court records may update at different times. Intake creates identifiers, a photograph, fingerprints, facility data, and charges supplied at admission. Magistrate Court then records the complaint, bond, counsel, and hearing events. Neither custody nor an initial charge proves guilt.

Kinds of Criminal Records

A Lewis County criminal history can describe several Lewis County records that never become one public file. The arresting agency writes the incident or arrest report. DCR creates the booking entry. Magistrate and Circuit clerks preserve the court trail. WVSP CIB receives fingerprint and disposition data for the repository.

• Booking records: DCR intake data from regional custody, including identifiers, facility, and charges supplied at admission.
• Court case files: Magistrate complaints, bail, and preliminary steps, followed by Circuit filings when a felony advances.
• Warrants and capias records: Court-issued process executed by the sheriff or another agency, with no complete public Lewis County list.
• Repository and supervision records: Fingerprint-linked CIB cycles, corrections data, probation, parole, and registry information held by distinct agencies.

Trace the arrest report, booking record, and first court entry separately instead of treating them as the same product.

Lewis County Criminal Record Offices

Most Lewis County court and law-enforcement counters cluster at 117 Court Avenue in Weston. The Lewis County Judicial Annex houses the Circuit Clerk, Magistrate Clerk, sheriff law-enforcement office, prosecutor, and court functions. It opened in 2013 to bring scattered justice offices together and improve the secure movement of detained defendants.

The historic county courthouse is next door at 110 Center Avenue, but it is not the main criminal-file counter. The county courthouse profile identifies the older government building.

Knowing the difference prevents a wasted stop. Court cases, sheriff reports, and prosecution records generally point to the Judicial Annex.

Lewis County Criminal Records: What They Contain

The fields depend on the record. An anonymized Lewis County Magistrate sample used a case pattern like 24-M21F-00029. Its sections included basic case data, charges, bond, scheduled events, parties, and a docket. The file showed complaint, initial appearance, rights, counsel, jail commitment, hearing, transfer, judgment, and motion entries. A transferred event still does not state a final outcome.

Read each Lewis County record status and source together. A booking charge can change, while a court disposition may appear later in a separate system. West Virginia does not use one statewide Class A, B, or C ladder for all crimes. State law divides offenses into felonies and misdemeanors, then each offense statute supplies its penalty. Felony cases generally begin with Magistrate Court steps and move to Circuit Court after transfer or indictment. Misdemeanors usually remain with the Magistrate Court.

Lewis County Warrant Record Gaps

No official Lewis County warrant database, active list, most-wanted page, or sheriff app was found. A court docket may show a warrant or capias event, but it is not reliable proof that the process remains active. A capias is an order that compels a person to appear or be taken into custody.

Circuit matters go to the Circuit Clerk at 304-269-8210 and may also appear in WVPASS. The sheriff at 304-269-8251 handles execution, but the issuing court controls bond and clearance. Weston city process should be checked with city or municipal staff and the police department.

If your own name is involved, contact the issuing clerk or counsel before acting on an old online entry. Sealed matters, juvenile process, and unexecuted investigative warrants may not be public.

West Virginia Public Access Laws

The West Virginia Freedom of Information Act gives any person a route to reasonably specified, nonexempt Lewis County public records. A Lewis County request should identify the office, incident, date, location, report or case number, record type, format, and contact details. Ask for existing records, not a new explanation. Within five days, excluding weekends and legal holidays, the Lewis County public body must provide access, state when and where it will be available, or give written reasons for denial.

For conviction petitions, the wait runs from the later of conviction, release from incarceration, or completion of supervision: one year for one misdemeanor, two years for multiple misdemeanors, and five years for a qualifying nonviolent felony transaction or series. Violent and other listed offenses are excluded.

The official SCA-C900 packet requires detailed identity, address, arrest, case, victim, sentence, and rehabilitation information. File through the proper Circuit Court and ask the Lewis County Circuit Clerk about the current fee and local procedure. A grant seals court records and directs agency expungement, but agencies may need up to 60 days to certify completion.

Correcting Lewis County Criminal Records

Start a Lewis County correction with the source of the error. A wrong charge, missing disposition, or duplicate court entry should be raised with the Lewis County court or arresting agency that submitted the information. Keep the case number, statute, disposition date, and a certified order when one exists. Portal support cannot replace the custodian’s correction.

The Lewis County FOIA page is the fallback when an existing sheriff or county record is not posted online. Its embedded field list was not accessible during research, so prepare a precise request instead of assuming which boxes appear.

Lewis County Justice Record History

The county’s record geography reflects two major changes. An older courthouse burned in 1886, but an official Judiciary history says the records were saved. The present Romanesque Revival courthouse dates to 1887 and 1888. More than a century later, justice offices were still spread among buildings, and detained defendants sometimes had to move outdoors between an older holding area and court.

The approximately $7 million Judicial Annex was dedicated on August 20, 2013. Its first floor was planned for magistrates, the clerk, probation, sheriff, and family court. Circuit courtrooms, the prosecutor, and judicial offices went upstairs. A secure holding connection improved safety and placed much of the Lewis County criminal record chain at one address.

Route the request by creator. A sheriff report goes to Sheriff Law Enforcement or the county FOIA process. A Weston incident belongs with Weston Police or the city. A trooper report uses WVSP Form 141. Booking data goes to DCR or Central Regional Jail, and filed court papers go to the Magistrate or Circuit Clerk. City-by-City Criminal Records in Lewis County

Lewis County has only two incorporated municipalities. Weston Police creates Lewis County city incident records, while municipal matters may remain with city staff before any state criminal case reaches the county courts. Jane Lew has no verified police portal or current municipal-court lookup, so its town office is the first place to confirm whether a local citation record exists. Lewis County sheriff, state police, court, and DCR channels remain the fallback.
